when we started our 13 we were a asset case but we let the house go back because we saw it our struggles a yr into plan now should our case be changed to a no asset case?

The asset, no asset distinction does not apply to chapter 13's. A chapter 13 is determined by disposable income. Even if you let your house go, if you still have disposable income, you would still be in a chapter 13.
