Our attorney told us that we need to list all people who have ever owned the debt. So you may want to see if you can find names and addresses of collection agencies.

yes, everything on the credit report is listed on my petition, but i didnt see a 2 of the cards listed on the credit report, i gave my atty. some original bills from those cards, so the account #s will be listed, im worried about other 2nd or 3rd parties

            Yep.

It's a $26 fee to amend your Creditor's Matrix, plus any fee your attny may charge to perform the service.

Even tho the debt is technically Discharged by listing the primary Creditor, Zombie Debt Collectors can hound you years after BK. It's really best to get the Collections Agencies and law firms listed right from the start. List as many of the 2nd, 3rd, 4th, etc Collections Agencies as you can for any accts that have been sold or turned over.

                hi,

by hounding, me do you mean they can sue to collect, or just call and send letters threatening to. if they can sue, how easy would it be for them to get a judgement even tho i can show the original acccount was included in the bk??

i apologise for all the questions, but im really starting to worry.
pre-filing panic attack maybe?? i have a pretrial mediation meeting i got summoned for on tuesday, so i really need to file monday. if i cant file monday i guess I'll have another judgment to deal with.

                thank you ,

Creditors can't sue for Discharged debts. Debts Discharged in BK come under a Permanent Injunction. Any Creditor contact violates the Permanent Injunction of Discharge.

BUT,.......... That does not stop Zombie Debt Collectors from trying years from now.

Creditors bundle bad debts and sell them off for pennies on the dollar. Then Zombie Debt Collectors try to turn a profit off the "bad notes" they bought.

Many people don't know their rights under the BK Law. They start getting the harassing phone calls and letters in the mail years after their BK is over and done with. Collectors will try to lead you to believe that they can collect on your old, Discharged debts.

The further down the food chain you can list your debts during your BK the better is all.
