    Question about listing judgement

    I FINALLY filed my BK!! The clerk was extemely nice and helpful - I'm hoping the rest of the people involved are this nice. BUT... my question is about a judgement I have. I listed the collection agency on my schedules and matrix but I somehow forgot to list the judgement. I though of it in the middle of the night after I filed. I don't know how I missed it since I was obsessing about this for months. There is no garnishment in place - I was making installment payments to the collection agency (which I stopped a couple months ago when I decided to file). Do I need to file an amendment including the judgement on my schedule and matrix to get rid of the judgement? I already sent them a letter with my case number on it in case the collection agency tries to garnish. I don't want to raise any flags by filing an amendment but I want to make sure it goes away.

    Cathy, This is an easy one! Just make the appropriate page again and complete it properly. Then call the court clerk, explain this minor omission, and ask her what she wants you to do with your corrected page.

    Whatever the answer is, the Court Ladies always know it!

    And something else about judgments - they don't completely "go away".

    While you're talking to the clerk, ask her what steps you should take after your bankruptcy to "vacate" (remove from the files) the judgment.

    While your bankruptcy stops collection connected with the judgment, it does not make it disappear. You'll have a few more steps and maybe a small filing fee after your bankruptcy.

    Nothing to worry about. But get the that correction made ASAP.

      Thanks for the info. I'm going to call them today and get it fixed. I'm still banging my head against the wall for this one! I think I'll go over all my paperwork (for the zillionth time) and make sure that was the only thing I missed!
