    Assumed doubleing?

    For the life of me I cannot find any info on weather or not a married couple filing in NH can double the exemptions.

    Is it a safe assumption that a married couple filing together can in fact double the exemptions listed?

    I checked for you, and I have not been able to find a single place that says it's doubled. But that doesn't mean it's not. The best and safest thing you could do instead of assuming the exemptions can be doubled is call your local clerk of the bankruptcy court. They should be able to help you with a simple questions like that. It's better to be safe and check.

      This is a tough one to answer...even in states that allow doubling, not all exemptions can be doubled.

      But what is your specific concern? What property do you think you may not be able to exempt unless the exemptions can be doubled.

      As a general matter, personal property exemptions can be doubled, because the exemption applies individually. Whereas in SOME states, the homestead exemption CANNOT be doubled...because the exemption is on the "homestead" not on the individual owners.

      Almost without exception, a husband and wife can claim a the full exemption in 2 cars, i.e. husband claims full exemption on car #1, and wife claims full exemption on car #2.

      But you are correct, I have not been able to find anything specific regarding NH, and I looked at the statute directly.

      The homestead exemption reads
      480:1 Amount. – Every person is entitled to $100,000 worth of his or her homestead, or of his or her interest therein, as a homestead. The homestead right created by this chapter shall exist in manufactured housing, as defined by RSA 674:31, which is owned and occupied as a dwelling by the same person but shall not exist in the land upon which the manufactured housing is situated if that land is not also owned by the owner of the manufactured housing.
      By my reading, that statute would seem to allow a "doubling" of the homestead exemption since it specifically mentions "every person"

      But I cannot give you any certain answer.

        Yes the exemptions are doubled sorta!!

        In as much as each person may claim the same exemption as long as each person has an interest is said property being claimed.
