I filed chapter 7 on Friday, pro se. The main thing that drove me was that my bank account was attached for thousands more than was in it. It did have 1200 in it.
Monday a.m. I faxed a copy of the petition and a demand for a release of my funds to the creditor attorney and the sheriff.
Today, my funds were still not released, so I decided to call the attorney, Mel Harris & Associates, and give them a taste of their own medicine. Everyone I got on the phone put me on hold and then hung up on me. I must have called back six times, only to get the same runaround. So......
I work for an attorneys office. I called back and hit the number that was for "If you are calling from an attorneys office....". Sure enough, a polite gentleman answered, and I said "I'm calling from the office of john doe & partners, do you want the social I'm calling on?" HE said yes, so I gave him my social security number. He said "Looks like there is a bankruptcy on that so the balance is zero." I said "Thats correct, but you haven't released the account with Citizens Bank." He said "Looks like we missed that. I will fax a release right now." He apologized and said the money should be available tomorrow.
I guess you have to play the game by their rules sometimes.
