    Violation of injunction?

    During my bankruptcy, my car was repossessed and was slated to be sold at auction. Now, Capital One Auto is reporting to the CRA's with "Paid in Settlement" and "Account legally paid in full for less than full balance" with Experian and now showing a balance and amount past due on Equifax which it did not prior to the car being auctioned. Are they violating the permanent injuction? They have done all of this since my bankruptcy was discharged and closed.

    If they repo'ed the car AFTER DISCHARGE, then there is no violation in that regard. (assuming, of course, you were behind on payments at the time).

    Regarding the credit reporting, your first course of action is to dispute the credit report entry....that will, more often than not, clear things up.

      I was cool with the repo and knew that was within their rights. It was done before the discharge. It saved me having to make arrangements (silver lining) I'm just ticked by them continuing to mess around with my credit report now that the discharge is final.
