Well, I've been following this forum for awhile and I've also been following its advice. Next week I will be going to court and hopefully will soon be going through the final stages of my divorce. As per this forum once the divorce is over I will be filing my bk. Most of the work is out of the way, the bk attorney has most of the information she needs to file and my fees are taken care of. I'm still uncertain of whether I will file 7 or 13 since that will be somewhat determined by the divorce decree. I do, however, have another question for the forum and it regards my divorce attorney payment and a little bk planning. Does anyone have any thoughts about paying off my divorce attorney and how the trustees will view that debt. I am also wondering if taking a loan on my 401k and paying the attorney would be viewed negatively or as a preferential payment. I know my divorce attorney has been great waiting for any money beyond the original retainer of $3K. There is no money, hence the bk. The house will be surrendered (or foreclosed during the bk, alimony and child support will be a wash so none is anticipated). Any thoughts?

I paid my divorce attorney strictly through credit card convenience checks to the tune of 35K. I had to do it to get through my divorce and get what I needed to survive. I waited out the 6 months and am now filing. Hoping too not to have any issues b/c of all the mega convenience checks I wrote to the divorce atty. I've been led to believe that paying your divorce atty is like paying for other "necessary" living expenses. I'm filing soon so I'll keep you posted if it turns out this wan't okay.11/14/07 -filed C7
12/04/07 -case pulled for random audit.
12/18/07 -341 held: Asset case due to engagement ring & tax return.
02/19/08 - US trustee files motion to extend.
04/02/08- changed back to NO ASSET! I get my ring back and get to keep my tax return! :clapping: 04/28/08 -DISCHARGED!!! :yahoo::yahoo: 05/07/08 - CLOSED!!!
