We filed chapter 13 in march 2007 Yes it has been a struggle to make the payments but we were doing them.Just yesterday we got a letter saying that we have an escrow shortage and that as of Dec.1 our new payments will be 500 more a month to make up the shortage.My husband called the mortgage company the escrow part the number was on the bill and they told him that we have a shortage of 11000 which my husband proceeded to tell them that it was included in the payments to the trustee it was in our plan after going back and forth for about 30 minutes they just keep telling him as of December 1st our new mortgage payment is 2600.I dont know what to do right now I feel like walking away from it all there is no way they are going to let up just when we thought we might be able to do it now this

If your arrears are included in your Plan and you had an attny file your plan for you,.......... You need to call your attny ASAP on Monday.
Sounds like your Lender may have their wires a bit crossed. Which can happen. Some Lenders are so big that regular Customer Servicing does not know what the Foreclosure and/or BK Depts are doing.
Contact your attny and get him/her moving on this.
Another thing you might be able to try is,........... Call your Lender and ask to be transferred to the BK Dept.
Generally speaking, when you file BK, your acct gets transferred to a special BK Dept. The Reps are specially trained in what they can and cannot say to you. What they can and cannot do with your acct.
The BK Dept may be able to get this whole mess cleared up for you.Filed Ch 7 - 09/06
