    I talked to an attorney today. what a disappointment!

    Don't you hate when you talk to an atty on the phone and they seem great but in person you think it must be someone completely different. I don't think this guy knew what he was doing.

    But he has to look into this...

    Do you know if you payoff your chp 13 off early and you surrender property but the mtg company has not sold the surrendered property, can they have the case reopen if the foreclosure process takes longer than your plan was to discharge. We plan to pay off in about 7 months everything else will be paid at 100% plan, but our atty didn't seem to know the answer.

    Also, he was wondering if any mtg companys that had property in FL went after the defiency bal. Most here in GA don't go after, but he wasn't sure if FL was different. We know they are able to, but do they actually do it. Any thoughts?


    I have another appt with another atty on Monday and on Wed, I sure hope they turn out better. The atty today couldn't even answer basic questions.

    Sorry I can't answer your questions but if I were you I'd talk to another attorney. I'm sure you don't want to pay money to an attorney that was that disappointing and couldn't answer your questions. Good luck!

      huh???? I am not sure anyone can answer that question Proof reading is an invaluable skill?

        I talked to another attorney today, what a disappointment!

        We have the same situation. We are 24 months into a 36 month plan. We surrendered our house and it was foreclosed on but they have not sold the property. Our attorney told us that when we complete the Chapter 13 the house debt will be discharged along with all the other claims and that the mortgage company cannot come after us for it.
