    Bad faith - what exactly is it?

    I'm trying to file a new bankruptcy case, because my prior one wad dismissed for failure to make Chapter 13 payments on time.

    My attorney is going to petition to extend the 30 day automatic stay. They told me as long as my case was filed in "bad faith" I should be fine.

    What exactly is "bad faith"?

    I'm not sure about how it is used for your filing, but when it comes to creditors, bad faith is when you take the money or use the card when you know you have no intention or way to pay it back.

      bad faith in refiling is stating that you keep filing over and over to get out of paying something or giving something back and by refiling you are delaying the process. If you were dismissed for non payment your key issue from the trustee would be "why will this one work and the last one didn't" If you can answer that and the trustee is satisfied, then you should be ok.
