I filed for bankruptcy this year and got discharged in the summer.
Anyway I am writing this for my mother. We live in OHIO.
My question is: Could you put the 1st and 2nd motrage on a bankruptcy, and have them discharged ( I don't think so but not sure). The reason why I am asking is explained below.
My mom is Blind and filed for bankruptcy in 1998 or 1999 well some where around that time. Anyway she has gotten in the big mess with her bills again, and I think that she should file again. The problem that I have with that is the property. She had a house that was almost paid off (around 6 months left). Someone called the city on her and we knew their were problems with the house, but when you only get almost $800 a month it is hard to make corrections at once (she was making minor corrections the main problem was the foundation of the house). To make a long story short they told her she had to move, they condemed the house, and they tore it down a couple of month ago. If she had a chance to sell the house the city would have had the first shot since there was a lean on the house for bad renovation work (the lean only had to be paid back When the house was sold). Then there is a second mortage. She had that when her husband was alive. When he died last year she had to have it redetermined because she could afford the payments. Anyway She had to move and with $800 a month after the rent and bills are paid there is nothing left at the end of the month. She had to abandon the 1st & 2nd mortage because she can't afford it. I think the property is in forclosure now. I think she is about $40k in the hole. I know that she has to include her bills in the bankruptcy, but I wanted to know about the mortages. Since the house is gone.
