My mother in law is getting ready to file. She is going to be surrendering her mobile home. My question is, should she file before she moves into the apartment or after, or does it not matter? The only reason she's filing a chapter 13 instead of a 7 is so she can keep her van and lower the payment and extend it out. They are well below the median income. She's disabled so she can't just go out and get any regular little car, she needs to keep the van. She will most likely be moving this coming weekend. She wanted to get an apartment secured before she filed.

Her advantage might be in the security deposit and the amount charged. My experience is that the worse the credit the higher the deposit. So if her credit is really bad now it might not matter if she gets it before or after. But remember to it takes a minute to repo a mobil home and she could be living there saving up her money in the meantime.
