    Do I have to send CC company a copy of my BK filing?

    Hello all; nice to get support for those of us having to file for bankruptcy. I filed mine pro se yesterday as a no asset case using the excellent Nolo book as a resource guide. My question concerns a particulat CC company creditor that I decided to fax info about my filing (date, where filed, case number, etc.) ahead of the court's official notice of my filing. I did that because my account with them is in their recovery dept. and will probably be sent on to an attorney or collection agency in a week or so if they don't get notice of my BK as soon as possible. Well, I called them today to verify if they got my fax and was told that I had to send them a copy _my entire BK filing_ or they couldn't update my file(!)

    My understanding is that by faxing them the filing date, case number, etc I had already put them on notice that I have actually filed BK (which means the automatic stay is in effect) and that if they want anymore information about my case it's up to THEM to get it on there own by calling the court. Do I actually have to send them a copy of my entire BK petition, or is this just some sort of bluff on their part?

    Uh..NO!

    Do Not send them your BK filing. If they want to see the documents.. they'll have to go to the courthouse and pay for them like any other interested party. You didn't have to fax them either. The court sends out the notices and that's that! As long as they are listed on your matrix- there's nothing else you have to do. They are blowing smoke you know where. Now, stop calling them, talking to them, thinking about them. If your case turns into an asset case, the court will let them know. Good Luck!

      Good to know that. Without the benefit of a lawyer when filing pro se, sometimes a thing like this can be momentarily confusing. Thanks for the confirmation.

        Make sure you included them in the list of crediters.
