Experience in discharge Texas 13's?

Hey out there,

I am getting close to being finished...I think. I have a 36 month plan. Originally, it was a 90% payment to unsecured creditors plan. After a good size tax refund, it turned to 100%. After another fortunate refund last spring, we are close to having the full amount paid off. 2 payments left would satisfy 100% of the debt obligations, even though there would technically be 6 months left in the plan. A few hopefully quick questions:

1. In your experience, how long has it taken for the discharge?
2. Did you have to make extra payments while waiting?
3. What was the process like? Was there a letter sent to you saying you've fulfilled the debt obligations?
4. Any goofy hoops you have to jump through that they don't tell you about?

Appreciate it!

To all of those struggling through the 13, keep your head up. There were times I never thought the end would be in sight. Keep yourself positive and know you are on the path to financial freedom!

I did an early pay off, so not sure how much different it would be. My trustee is Tom Powers. I filed in Dallas. Where did you file?

1. In your experience, how long has it taken for the discharge?

It was about a month for me.

2. Did you have to make extra payments while waiting?

Since I did a pay off, no. Not sure about your situation. Call the trustee's office.

3. What was the process like? Was there a letter sent to you saying you've fulfilled the debt obligations?

I sent in a copy of the pay off letter that was sent to me when I requested a pay off along with the pay off in a cashier's check. This was in October. A few weeks later (sometime mid November) I received a letter from the trustee's office congratulating me on finishing my chapter 13, wishing me good luck in my "fresh start", and that I should "soon" be receiving papers stating that the trustee will be discharged from his duties. I have yet to receive those papers.

I've checked Pacer. I'm discharged. The court papers are filed and I copied them to my hard drive in PDF format. But I want the ones that the trustee is supposed to send me. Still waiting on those.

4. Any goofy hoops you have to jump through that they don't tell you about?

None so far. I think that's going to be it for me.

And hey, atleast they're not FLAMING hoops! :D

Good luck! Call your trustee to see the status of your case if you're all paid off.

Thanks for the response! My trustee is Janna Countryman in Plano. I'll give a call to the office as soon as I send that last payment in January...

Congrats on your discharge!

I am confused our lawyer said do not try to pay the 13 off early or pay extra because they will audit us..They also are going to take all tax returns and they do not go towards our balance..
