    Capital One Personal Loans/Trans Union

    Please could someone give me advice. I recently received my discharge in the mail from the Bankruptcy Courts. Of course I requested a copy of my credit report and for the most part 80 percent of the accounts in question have -0- balances and say Included in Bankruptcy of Chapter 7 Bankruptcy. There are those that say In Good Standing because I reaffirmed them and then there are those that are not there at all. Its only one that is not listed at all and that is the 7000.00 personal loan that I took out with Capital One in 1-2006 and continued to pay until 7-2007 at which time I just did not have anymore money.

    The credit report TransUnion does not even list Capital One loan so I went online to the old account location where I used to log in and tried to find out more information. I actually got through with my old password and user ID and on the internet it says that Payment amount Due -0-, Interest rate 0/0, Next payment 10-14-07, daily interest accrual 0/0 and balance 7064.00.

    Why is this delinquent account not listed anywhere? Who has delt with Capital One personal loans and what should I do? I did not receive any objections, I have no ASSETS, I do not own anything but I remember that at the end of my discharge paper, it clearly said that there are some debts that are not discharable. If I remember correctly, Capital One Loans was one that was discharable. Am I wrong

    Yes, it would be discharged. The only things not dischargeable are things like student loans and tax debts, and other legal obligations - not credit companies. All credit companies are dischargeable unless they filed and won an objection (you would know if they did).

    Did you list them in your petition? (I know in at least some states it doesn't matter if you listed them or not, in others it might..?) I'd start by calling them to tell them it was included in bankruptcy and they'll probably want to see a copy of your discharge. I imagine that is about all there will be to it.

      The debt was discharded.
      Leave it alone. Why would you want 1 more account reading IIB?

        No I looked over my paperwork and there it was listed as delivered to Capital One by the courts and the date of deliver. I also saw it on Pacer a few months ago as deliverable. But it sure isn,t listed on my credit report. They do not even have it down as money owed. They are not there period.

        Note: I cut and paste the entire page. I know you will find it helpful.

          Maybe you misunderstood me. I also said that after I requested my credit report, Capital One is not on the report as cleared, owed or anything. This concerns me because at the end of the discharge paperwork there is a note to be advised "a debt will not be discharged if mistakes were made where debt was not included". Of course I ran to the paperwork to check and it was included, the address was correct, they were sent the automatic stay via hand delivery yet it is not listed on my credit report.

            It is discharged. You have 3 options 1.do nothing. 2. call them and make sure it is listed in their system as discharged .3. dispute it with the credit reporting agencies. Alot of the debts I included in my BK that I had to dispute because they still showed as being in collections ended up being deleted. Just disput the accout as being closed and discharged in chapter 7 bk. one of two things will happen either they list it as included in bankruptcy or they delete it altogether. You have nothing to worry about it was included and it had no objections and now you are discharged and that debt is gone gone gone. by the way long time no talk congradulations on the discharge. I told you that you could do it and you did it all by yourself pro se. Now dont that feel good.
            Sometimes life make you deal with ugly and hateful people ,just think of them as sand paper. They may scratch you and rub you the wrong way but eventually you end up smooth and polished and the sand paper becomes old and worn out.

              There was an article on the news forum not too long ago about this but when I went to find it, the link had a new story that had nothing to do with bk.

              maybe you should send your discharge papers ect. with a return receipt to this cc company.

              i think it is a new tactic in that years down the road, after you have rebuilt your credit and are applying for a mortgage they try to hold you captive to this debt by claiming they never knew it was included in the bk.

                To 6ftladycop: in your original post you say that you looked on your Transunion report. What about the others -Equifax, Experian? Remember some creditors might only report to one CRA, some to two, and some to all three. You say nothing is on Transunion - so don't worry about it, but get the others. If it doesn't show ON ANY then CAP ONE's computer recording is flawed.
                If in the future some collection goons contact you about this debt just send them a copy of your discharge papers and tell them what Vice President Cheney said to a senator on an open mike on the Senate floor a few years ago. If a male collector calls you tell him to make a date with Lorena Bobbit.
