Had our 341 meeting in April. Last day for objections is June 27. When we listed our budget we had listed the two truck payments that we have. But now we have decided not to reaffirm one truck. I asked my attorney if this will hurt our discharge at all and he said no that the Trustee wont know. I was just wondering if anyone else had this similiar situation. Im afraid if we dont reaffirm the truck that the trustee will find out and see that we now have some extra money a month.

Were you presented with a reaffirmation agreement? Did you know that you are not required to sign an affirmation agreement? There is no law that says you must.. no one can make you. Not even the court and especially not the auto co. You'll have to check with your lawyer on how to return the truck after the discharge, if that's what you want to do.
BTW- Congrats on your up-coming June 27 DISCHARGE! Couple more weeks!

The bank we have the truck thru sent our attorney a letter stating they see we filed bankruptcy and we can either sign the paper for reaffirming or if we want to surrender it there is a number to call to make arrangements. We want to surrender it because we already paid 5 years on it and have another 4 to go and its old and not worth the $12,000 we still owe. (husband did a dumb move and leased it to begin with for 5 years. dink lol) Attorney said since we just made this months payment drive it for another month then call the number to have them come get it. Our discharge should be thru by then but wasnt sure if we had to have this done before the discharge and want to make sure the trustee wont go back and review our case and see we dont have the extra truck payment even though we will have to get another truck within in the next year anyways.

I would listen to your lawyer.. it seems like sound advice! I wouldn't do anything other than what your doing- especially because the discharge is so close! Give the vehicle back at the end of this term that you've already paid for.. I'm sure the auto co won't even try to contact you til then, either.
