I have a question about my first payment. I get paid tomorrow, the 29th of December and my first payment is due January 9th. I am going to make my first payment out of this check but how do I know when they are going to start taking out payments? If my employer takes out payments starting on the 12th of January then by the 9th of February I will have paid more than I should in that time period. That would be my payment out of this check plus another whole payment by the 26th. Anyone know how that works? Since the payment is due by the 9th of January I just can't see what happens I suppose before sending out my first payment? Thanks.

That is something you may want to email your atty on. But please make sure you send your payment out TODAY. My first payment is due on 1/3/08 and I mailed it on the first of Dec. It has just now cleared my bank account on 12/21. I was terrified that it had got lost so I emailed the trustee on 12/20 and they confirmed they had received it. I was scared because I had heard that when you mail the checks in, be sure to mail very early because it takes the trustee forever to post them.

We had a similar scenario...and we ended up being kind of one payment ahead. I say "kind-of" because it takes forever for the trustee to GET my payment from my employer. But I'd rather it be that way then be late. It took my employer 3 payperiods (bi-weekly) to get the garnishment set up with ADP, etc...Chapter 13 Filed: 2/7/07 Confirmed: 5/1/07 Discharged: 3/2/2012 Closed: 6/2/2012
