Well, hubby was served with garnishment papers this morning. Starting this week, Chase will be taking a chunk out of his paycheck.
I've been posting on this board since Christmas day of 2006. I've been trying to get my ducks in a row. Then 2007 blew us away with me getting cancer. I finished all radiation in December.

I have a small cancer policy through hubby's benefits and want to file for that and get it back before filing for bk. I don't see how we can file without lots of red flags before June.

I have consulted with 3 lawyers so far and I'm not comfortable with any of them.

So, about the garnishment.......I assume this is after taxes??
Also, will his job be at risk? It's going to be 5-6 months of this before we file.

Most states garnishment can only be up to 25% of paycheck and I believe that is after taxes (but I'm not certain)......

When you file bankruptcy that will all stop......

In New Jersey, garnishment limits are 10% of gross pay or 25% of net pay - whichever is less - if I am not mistaken (and I could be)

I do not have any garnishments just yet, but I did go speak with HR a while back about the process. (Thought I might give them a head's up.)

In some states it is 100% illegal to fire an employee over garnishments, even multiple garnishments.

Different states haev different laws protecting employees.
