    Cash advances are not much of an issue in a chapter 13...yes, you need to wait the 70 days...but in a chapter 13 since you are paying back money, there is little reason for the creditor to object.

          I made the mistake of paying the minimums on all of my credit cards right up until the very moment that I filed. What a waste. I didn't have enough money for gas/food/necessities because I wanted to make sure my creditors were paid first. There is no point to this. NONE!!!

          Make sure your necessities are paid.That would include housing, food, clothing (but not gambling ;). Then pay whatever you can to your creditors for the next three months if you feel it is necessary.

            HOW important is it to wait the 70 days if you have taken out a cash advance? If you are going to be near 100% payback, what do the creditors say? How does that work? What happens if you file within that time?

              I had some charges

              lots of credit card debt and tax debt... Went to see attorney 10 months ago.... Said quit paying cards tear em up use em up what ever. Then you play the waiting game wait until they file a lawsuit for non pay then bingo hit the chapt 13 button and start the repay.. You got bout a 11 month window to work with to pay and get ready. Just do this. If your homeowner keep house current, if you like your car keep your car current all other creditors do not pay... Its a waste use this window of time to get ready for bankruptcy. IS legal sound advice....

                I can only tell you from my knowledge under the old law--it would not have been important at all. I was extremely paranoid about a charge I had made in the month preior to filing and my attorney didn't blink twice nor did anyone ask me anything about it. I'm not sure about now with the new law changes . .
