    Looking for lawyer near Tac, WA for chap 13

    If I do a search on google or a find a local lawyer type site we get like 500+ lawyers in our area. We are looking for anyones good or bad experience with area lawyers, so we know who to try meeting with first or to skip.

    Got F/C notice on the house saturday, they say we are about $8000 behind and we dont have that. The house is under my wifes name,this will be our 4th year in the house, we have been married 2 years. I think we owe about 160,000 on the house out of the 189,000 we paid.

    I dont know if it matters, but the F/C notice has her old maiden name on it, and it says an unmarried woman after her name. We had informed the bank of her new name when we got married, so does it matter the person named no longer legally exists and the marital status is incorrect?


    For about 3 months Washington Mutual has been sending us all kinds of stuff to fill out and send back so we can work out payment arrangements. They want bank statements, paycheck stubs, monthly bills, etc... She filled it out & sent it back, they said they never got it. She filled it out again and resent it, they still said they didnt get it, we faxed it in, they gave us 5 different fax #s over that time period, some of the fax #s never worked. Each time we called they said we had to fax it to a different # than we got last time. She would sit on hold with there loss department, one time for 30 minutes, then was hung up on, called right back and there machine said they were now closed, that was at 2pm. The times we did talk to someone they would always say they had no record we had called before and it appeared we had been taking no action to save our house.

    We got a letter that told us to work with Hope Now, they never answered, when they did they just said call back later they were to busy. We asked them to take our # and have someone call us back but they wont do that.

    We tried to set up meetings with a local non-profit credit counseling place. We never actually even got to talk to them. They never answered there phone and we always got the message the voice mail system was full and could no longer accept messages.

    We have been tring to work with someone for months but Washington Mutual could totally care less. There service people are often rude when we call or have no idea what to do.

    So now we got a F/C notice, we are now must to go chap 13 to keep the house, I guess that will force them to talk to us. We will be able to keep making our full payments and repay the 8000$ over time. Just we cant pay it all back today.

    She also has about 17,000$ in CC debt, many of those are behind. She has repayment plans with some of them where they automatically debit her account, but some of them are still charging super high interest, over limit frees, late fees, yearly enrollment fees, etc... so by they time they take 70$ only like 30 is paying down the account. It will take 10 or more years to ever pay these off at the rate they are ripping people off.

    We had one law office for a bill collector call us at 5:50 am today,I believe that is totally illegal. We thought someone had been in an accident or something getting a call at that time. These people are driving us crazy even though she has set up repayment plans they call back and want more money and they want it right now. They say things like they are giving us a special one time payoff discount, even though she cant hardly make the minimum payment they think we have an extra 5000$ just for them . They say go get a loan, borrow from your family, etc... because this is a one time offer we cant make again. We did not ask them for a payoff in the first place. More debt would not help the situation but they do not care.

    She has about 2 years and 10,000$ left on her car at 2.9%, and thats not late or behind. So I would think we would not want to add that into the repayment plan, as it could be at higher interest that she has now.

    I think as bankruptcys go this wont be to bad, no kids, no childsupport, no overdue taxes, just out of control insterest, late fees and late payments. Area of major concern is the house of course. She has been employed for 4 years at the same job, Ive been at mine longer that 10. So I think we will have no problem working something out.

    Hi Bob I am in Puyallup in the same situation just got our F/C notice last week but right now they are really behind so that isnt our biggest worry ours is the house is worth 450K and we owe 530K so we are thinking go ahead and surrended the house and buy another in a few years when the market comes back around!

    As far as attorneys make sure to meet with a few I havent had the best luck in our area finding anyone good either! I just got a Private message from another member with a name for a laywer they used and they said he was good I can forward it to you if you like!

    The other thing to think about is short saleing the house if you decide not to keep it! I work in the real estate field and could help with that if you like! just rember to hang in there and ask questions this forum will help alot!
