    Getting a new card before filing

    I will be filing chap.7 probably within 3 to 4 weeks. I was going to pay off my lowest balance card(612.00) before filing so i might have an emergency card after bk. My lawyer told me don't do it or it will look bad to trustee. Since i may still be able to get a new card now and just never use it would this be ok or would this be viewed badly by trustee? Would he even know? It is almost impossible to get by without a card in this day and age. Also the charges on the card i was going to pay off were all made in june so i may have to pay them anyway even though they were all for necessities. Anyone with any knowledge in this area i would appreciate your insight.

    As for the Bankruptcy, its probably better to get a new card and NOT use it than pay off the low balance card, only because you are required to disclose payments to creditors of over $600 within 90 days of filing BK and it begs the question, where did the $600 come from, and the trustee could find out about it, because it will either be reflected on your bank statement and if the trustee wanted too, he/she could request recent credit card statements (although that is rare).

    I take a small issue about whether you NEED a card in today's day and age, with debit cards being cash on demand, needing a credit card is questionable. However, I understand the premise behind having an emergency card, but the problem is, most peoples definition of the emergency is quite fluid.

    If your using credit card for neccesities, then you have deeper issues you need to resolve. You need to spend time working on a budget (you have to do this for the BK anyway), and take a hard look at where your money is going.
