I Filed A Chapter 7 And If The U.s. Trustee Dismiss My Case Then When Will I Be Allowed To Refile A Chapter 7. She Is Saying That It Is Presummed Abuse And I Really Need To Know If I Need To Go To Court Or Do My Lawyer Try And Make Her Understand That I Am Not Making The Overtime Money I Was When June -november Checks Stubs Was Sent To Her. Do The Trustee Add Part Of Husbands Income In With Mine And If So Shouldn't I Add His Part Of The Bill Around The House On The Schedule J. On The Schedule J It Only List My Part Of The House Payment And My Part Of Every Bill Around The House. Should The Lawyer Have Added The Full Amount Of The Bills And Figured It From There. I Am Married And Filed Alone And I Have One Child. I Live In Virginia And Need To File Chapter 7 Or Something To Get Some Reliefe.

Yes, your husbands bills should also be included.
Call your lawyer. It may be possible to file CH 7 even if you are above the mean, but you have to prove you have no disposable income (and that your expenses are reasonable) on your schedules.
