Ok, here's my situation.
I filed chapter 7, and reaffirmed my vehicle purchase. On further reflection, I decided it would be better to surrender the vehicle.
I amended the bankruptcy paperwork to show that I would be surrendering, and sent a copt to the leinholder.
I heard nothing from the leinholder.
My debts were discharged on June 2.
On June 20th, I get a call saying my car is going to be repoed for non payment. I told him I sent in paperwork which changed it to a voluntary surrender. He says "oh, okay, I'll change it to a voluntary."
So I check my credit report, and it has a 30 day non-payment on it. I told him I was under chapter 7 protection, he tells me it doesn't matter, i either needed to surrender the car before my payment was due ("you shouldn't have been driving it around"), or make the payment.
He may be right, but I was under the impression I was protected from payments under chapter 7.
What did I do wrong? Or did I do anything wrong? Can this get taken off of my credit report?
(I did this all pro se, and do not have an attorney).
