when two people share ownership in a home, does right of survivorship have to be listed on deed, or does the other persons share automatically go to the other person when one dies, i live in Florida and we are not married.
How exactly does the deed describe the ownership interest
1. Joint Tenancy
2. Tenancy in Common
If its Joint Tenancy, the general rule is that there exists a right of Survivorship between the joint tenants, but some states require that, even if the deed designates Joint Tenancy, the right of survivorship to be expressly stated in the deed, I don't know what Florida's rules are concerning whether right of survivorship must be expressly stated.

the deed just lists both names but neither jt or tennant in common is mentioned. it just lists both names. with AND between our names. can this be changed to right of survivorship without a attorney. can we just file a new deed?
