    Received Discharge!!

    Just checked Pacer and it states our case was discharged and closed on 6/21/05!!!

    The actual Order for Discharge of Debtor states the following (in summary of course):

    1. Debtor is discharged
    2. Trustee is discharged as trustee and bond is cancelled
    3. Chapter 7 case is closed

    I didn't expect the Discharge to reflect the case is closed. From other posts within the forum, I assumed the case wouldn't officially be closed until 6 months to a year after discharge. Am I reading too much into the notice?

    What else could it mean other than you had a successful chapter 7. I'm happy for you and hope mine come in a few weeks without problems.

        Our last day for objection is this monday June 27. I hope we get our discharge soon afterwards. But when I check on Pacer the status still says awaiting 341 meeting, awaiting closing. But under the deadline section it says the 341 meeting terminated which we had April 28 and was terminated April 29. And says Trustee reports no assests for distribution which I know is good. Im sure if anyone was to object we wouldve heard something by now. Plus my friends discharge was just ordered Friday June 24 and her last objection date was June 6. So I am hoping we we will receive ours within a few weeks. Does anyone know if the discharge goes to our lawyer and he gives me a copy or does the court send a copy to both me and the lawyer?

            tdooders you will get your "get out of jail free" card in the mail. Keep ALL of your docs. neat and in order, you will need them down the road as you rebuild your finances.

              Thanks!! I know I shouldn't feel happy about being bankrupt but honestly, it's the best feeling I've had in a LONG time especially since it's over. To think that just 5 months ago things were REALLY bad (such an understatement) and creditors were calling my home and work from 7AM until 9PM nonstop.

              Lilkim, I have no specific advice - other than hang in there and hopefully it won't take but about 3 months from start to finish, that's about how long mine did; filed on 3/7, 341 meeting on 4/7, objection by creditors deadline was 6/6 and received discharge on 6/21. I went into the process pretty much clueless but the advice and support on this forum have been tremendous. Stay plugged in and you'll learn a lot, I have.

                I got my Discharge in the mail yesterday.
                I have 2 questions
                1) When do I get a list showing which accounts are discharges
                and which,if any,were'nt
                2) Did you pay to access Pacer?

                  1. You won't. The bankruptcy code pre-determines what debts are and are not dischargable. If you listed mostly unsecured debts (i.e. credit cards, medical bills), unless a creditor objected (you would know if they did), then those debts are discharged, if you had IRS, Child Support, or Student Loans, those debts are typically not discharged even if you listed them.

                    Some Student Loans Are Dischargeable?

                    HHM, I spoke with the bank that issued my student loan and they themselves said that it is a private bank loan and they have writen it off. Of course they like none of my other creditors showed up at the 341.

                    I am waiting for my discharge in another 5 weeks or so. If it is discharged would the bank who said they couldn't collect try to do it after the idscharge?

                      I know that private students loans are discharged, I suppose I should have qualified my statements to say federal student loans, but to answer your question, you don't receive a list from the BK court of debts that are and are not discharged in yoru case.

                        One of my debts listed was Public Assistance
                        I did'nt get the help,my son's mother did(we were never married)
                        It is'nt technically child support.
                        I wonder if it got Discharged?


                        Also,I called my lawyer about a breakdown sheet
                        listing my discharges,he was'nt in(as usual)but,his
                        secretary said they would get a "certificate"
                        and they would send it to me listing all discharged debt?

                          Got my discharge in the mail yesterday. Thank goodness this is over!!! Now I can get on with my life!

                            hi linsc!! i was wondering if they even bothered looking at your checking account statements and if so to what extent did they go over them? did they question any purcheses that you made or what? just wondering what to expect. also, how did your meeting with the paralegal go? sorry for all the ?`s, i am just nervous.

                              YOUR LOOKING GOOD NOW.....your's is final if it says "case closed"....
