Doing the means test, I'm pretty sure wife and I would need to do a Ch13 ($118k income by me, $0 by her, $300 income child support for stepson, seven kids total).
We are separated -- not legally separated, but we must be due to DV -- and we have no idea if we're going to get back together or not. We were in over our heads and barely making payments before we were separated, so we're rather worse off now that there is a 2nd rent payment.
Extra expenses: mandatory group therapy around DV ($200/month), marriage counseling ($320/month) and a separate apartment ($500/month).
Can any/all of these be considered in means test and budget in Ch13 BK w/o a legal separation (which is it's own expense that we don't want to do if not necessary)? They would eat all of our "disposable" income, I believe, and qualify us for Ch7. Without considering them, we'd probably not be able to do them -- which would mean we would get separated if not divorced (ugh).
