    341 Pro Se next week, very nervous

    I have my 341 next week. Pro se, and no asset case to say the LEAST.
    From what I've read many people show up without pay stubs, bank account records, etc.

    Is this ok or advisable? I would prefer not to offer any unrequested or unnecessary info that might screw up my case or something in a way I can't foresee. My BK papers are very accurate, etc. Are they enough info in a typical no asset case?

    I took everything with me as well, but none of it was ever looked at. But you probably should take everything just in case. Better to have it and not need it than to need it and not have it.

      I was very nervous about mine too and I took tax returns (for 3 years, I guess I'm an overachiever! lol), pay stubs (for about 1 year give or take a few missing ones) and bank statements (for about 4 months) with me just in case. I was also pro se and my case was pretty simple with no assets. I'm in California and my 341 turned out to be a walk in the park, much more informal and far less scary than I expected. All the trustee wanted to see was my DL and SS card plus the pink form everyone who had used a paralegal service and not a lawyer had to fill out there, stating who helped with the paperwork, how much you paid them, etc. I think that's probably only in California(?) because of some fraud that apparently has been going on here with such services. It did help calm my nerves to feel prepared by having all that documentation with me, plus I rehearsed an answer to "why are you filing bk?" - turned out I wasn't asked that question at all. The trustee asked questions like "Did you sign your bk paperwork?" "Did you read the green pamphlet?" (it explained all about BK and the different chapters, etc., required reading, available in the lobby) "Did you list all your assets?" (even though I didn't have any), "Did you list all your creditors?" - just general questions, nothing tricky or difficult to answer. It sounds like your 341 should go smoothly if your case is simple and straightforward. What a lot of people here have said, and my trustee said it too actually, is just be very honest and answer the questions truthfully and you should have no problems. Good luck!!
