    What happens if you don't go through with bankrutcy?

    Hello I was wondering what wuld happn if I changed my mind and just not claim bankruptcy ? For the past 10 years all my creditors that I had example medical , car payment, I did not have any credit cards well they never really bothered me never sued me . but then again i never owned a house. Well my thought is what would really happen if I just did not pay them changed my phone numbers . And did not claim all we have done so far is pay an attorney half down we have not filed , we stopped paying about two months ago and just ignore all the phone calls . This bankruptcy seems to me like such a headache it is so involved on having to get all the judgement copys all creditors I am honestly Stressed out over it all then we come to a rock of that we might not quailfy for 7.. then my husband lost his job and now we do it has been kinda a rollor coaster . We were not really interested in 13 . If we are starting over then all we would want to do is 7 if we qualify. as of right now we do again. so we will see I just had this brainstorm what would happen and who cares if they all put judgements on my house I just will never sell it .. but at least we will always have a place to live or we could always rent it out.. well these are just thoughts of a stressed out wife .. Most likely we will be filing but that question keeps coming up in my mind.. Do we take that chance??? well any thoughts on this matter please reply thanks ...

    Look at bankruptcy as a legal line in the sand. Once you file and draw that line, no creditor(that you listed) can cross that line (try to collect money that you owe). If you don't file I think (and this can vary by state) that thay have up to 2 years to sue you. Also if they are persisitent and keep selling the debt it can remain on your credit report for more than 7 years. (The house people said that my deficient balance would remain on my credit for 15 years).

    Bankruptcy just takes away the chance of something coming back on you in the future. If you are willing to take that chance don't file. If you already have bad credit and just want a fresh start, I say file.

      Thanks , Yes my score is like 580 really stinks .. I can't get anything if I tried . my score was like 630 a year ago but I was overdrawn on credit and it just keps on droping. I guess what I am saying is I am just getting discouraged , hoping that I am doing the right thing I am also scared of going to court a little , there is so much that I have come across example : aggravation but I am sure it is better in the end My husband goes through jobs like crazy he has a learning disability and usually keeps a job maybe 3-4 months . so we are on a rollor coaster the last job he had was a good one until they learned he was not able to spell . which always causes a problem. I feel so bad for him we just got married two years ago and he has been struggling to keep our finances up. it has been a nightmare robbing peter to pay paul. well thanks and if we go through with filing we will do it next week. Thanks for you respsonse.

        A bankruptcy will bring certainty to the status of your debts, that should be more comforting than your current situation.
