Please Help Me Figure These Out...

Hi everyone, I have some questions, and your answers will help me tremendously.
1) As IRS’ website says for KS monthly expenses a family of four can spend on food, utilities and non mortgage is $1793.00
In past three months, one month I have spend $1343 out of $1793. Next month we spent $1093, and month after that we spent $1993.
Is this ok?
I am having trouble fitting into these amounts as it is. Now I need to save from this $1793 to pay to my attorney. My fear is that trustee will say, if you can save and pay attorney, WHY DON’T YOU JUST CONTINUE THIS WAY, SAVE AND PAY YOUR CREDITORS??
What I am trying to cut and save is from clothing, personal care, misc. expenses and medical.
Is this ok? Is it justified?
2) I am not over median, and waiting for my six months to finish and then file. The very first month (out of these six months) I had extra money in the account and I paid minimum to SOME of my creditors. Is this gonna hurt?

3) I have a paid-off truck $3000 & my wife has a paid-off car $10,000 and our daughter has a car we are making payments on (its current) $4800. Are we gonna lose a car? Our car exempt total for the state is 20K.
Thanks for inputs…. Please help me….. Can’t sleep at night worrying. :(

EJ, your car exemption is based on the Blue Book value. You can go here to see what the value of your cars really are: www.kbb.com

Your expenses are AVERAGE expenses not month by month. So you are fine on that, I think. You are spending an average (those 3 months) of $1476/month.

The Trustee is not going to ask that question (why you can't save in this way to pay your creditors). For one thing, the only reason you CAN save in this way to pay for your attorney is because you are NOT paying your creditors!

Just make sure your income stays under the median for the AVERAGE of the 6 mo. before filing (preferably not increasing too much towards the end of that 6 months) and you'll be fine.
