Now What?? Atty rec'd letter to move from 7 to 13

Ok, I just rece'd a call from my atty. He said he rec'd a letter where the BK court is pushing to move from a 7 to a 13. I looked at Pacer and didn't see anything like this. My atty said he needs all kind of stuff. I've given him everything. Now what could he want. My meeting is tomorrow at noon.

Anyone ever have this happen? Ugh, my worst nightmare coming true!!!

Odds are, your attorney got a courtesy call from the US trustee informing him that they will likely seek a motion to declare the filing an abuse and move you from a 7 to a 13. Thus, your attorney probably neeeds more info to possible satisfy the US trustee and keep you in a 7.

Do you know what kind of info he may need? I can't imagine what? I've given him all my pay stubs (6 months), bank statements (6 months) tax returns (4 years), bills, etc. I know when I filed 7, my atty said they may object and try and force me into a 13, not to be suprised. It's probably because of the furniture payment ($210) that will be paid in 6 months. My atty said the trusty will see this and feel that after 6 months I will have an extra $210 to pay in a 13. Presently I only have $81 each month left over after paying everything. If I have to go to a 13, when will my first payment be? 30 Days from when I filed the 7 (2/8/08) or a different date? Thanks for your help. Now I'm really worried.
