I hope someone can help me with this question. I had Parent Plus loans to help my daughter, consolidated 2 loans with EdFinancial into 1 payment and paid on it for a couple of years before filing BK13.
In my Summary Notice of Claims Filed, the loans were separated with Sallie Mae as 1 Creditor shown as a Continuing Debt "Student Loan Claim" with around $1,500. The other Creditor is Education Management Credit Corp. (EMCC) showing as "Unlisted Unsecured Claim" with a total of $10,000. There is no mention of it being a student loan.
My lawyer said that EMCC filed a Transfer of Claim and he did not understand why the Trustee has categorized it as Unlisted. Each month $105 goes to the student loans and according to Pacer only the Sallie Mae loan is getting paid. It should be paid in the next couple of months and I wonder if the $105 will then go to EMCC.
The lawyer said that there is no need to modify the plan since the debt was already scheduled. I've been thinking about writing to the Trustee and asking about the EMCC loan and why it is not listed as a Student Loan. Is that a good idea? Any thoughts? Thanks for any advice or experience.
