    can my tenant sue me if I file BK?

    I moved out of my house to sell it. I moved into a smaller house with a reasonable rent. House didn't sell. Now I think I may have to file. Can my tenant sue me? He signed a 1 year lease/purchase aggreement?
    I need help! I have $90K in CC's and I'm not sure how much longer I can wait. I haven't a paid CC's in over 6 months.
    Need advice soon.

    Just name him as a creditor. That'll stop any litigation.
    This is just a general statement. I don't know of there are any potential "gotchas" that pretain to your states real estate laws that govern lease/purchases.

      What do you mean a creditor?

      I am not sure I understand. We still own the house and his rent pays the mortgage for us. If we file BK and have to evict them (ask them to leave) do they have grounds to sue us. I am not sure I get the creditor idea. Sorry. Explain. Thanks

        I just mean you should list everyone who could potentially file a claim against you in your bk filing.

            If you did a "lease purchase", you may need to refund that portion of the rent payment that was to go to a purchase, but whether you need to do so depends on how the lease is worded and your state's law.

            Also, why would you go to the trouble to evict them, if you are going to lose the house anyway, why incur the expense to evict the tenants?
