    Surrender Vehicle

    I'm new here, and I'm sorry for asking this question again as I'm sure its already been answered, but.... We've filed a Chapter 7. We had our 341 which I guess is the meeting of Creditors, and everything went fine. We are planning on surrendering our vehicle. We put it down in the paperwork. About a month ago we put a dent in the side. 1. Will this matter? and 2. I've read some concerns about surrendering and repos... If I want to surrender, besides telling my lawyer and putting it down in the paperwork, is there anything else I need to do? And 3. When will they come take the car? After my case is closed? Or anytime from here on out? Any help would be great! Thanks.

    I surrendered my vehicle before the 341 meeting. I emailed the bank and told them I was surrendering it. They wanted me to sign some paper stating I was liable for any money owed to them even though I was surrendering the vehicle. On Wednesday they told me they would get it on Friday, when I refused to sign that paper they picked it up that Wednesday night

    I had already cleaned it out and taken off my plates. They already sold it...

      Why would you have been liable for any money owed to them if you were surrenduring?

        You wouldn't if you listed it in the bankruptcy. Sounds like they were being shady and trying to slip something by her. Good thing she didn't sign. Might talk to your attorney about it though. I think it is illegal for them to approach you about a debt while you are in bankruptcy.

          On our petition we orginially said we were going to reaffirm one of our trucks. Had the 341 meeting in April. In May the bank sent a reaffirmation agreement for the truck but we decided then we didnt want to reaffirm it so we just called the number on the agreement where it said if we wanted to surrender it call. They still havent picked it up. They said they would call to make arrangements to pick it up. The truck isnt worth what we owe on it. Owe $12,000 and its worth maybe $5000. Also we were discharged June 29 and the truck is included in the bankruptcy.

            A friend of mine had her car parked outside her house for over a year and a half before they picked it up. Apparently it wasn't that valuable to them.

                Only if you've dropped the insurance.. other than that, it's yours til they take it.

                  So, here's the deal on the insurance thing... We didn't get insurance thru a regular insurance company. Wells Fargo Financial (the bank we financed the car thru) insured us for an extra 80 dollars a month. The thing with that was that they said if we ever get pulled over, we wouldn't have proof of insurance even though WFF was insuring us. So, since we stopped making payments on the car, we stopped paying insurance... have we been driving it around without insurance? And if we have, besides being illegal, is that bad?

                    I Hit a Tree

                    It was crossing the road At least thats my BS story and i am not sticking to it. (I was backing up in a camp ground ) I can't say much on the law but I gave the bank a car that had been around and had a few hits to prove it.

                    Now after discharge they own the car and my report reads "surendered" something something.

                    So i don't think a normal dent is a problem, I heard story about somebody who filled his car with cement when it was time to return it to the bank. The bank was able sue the guy and he ended up paying for the car even after it was included in the bk. I think they said it was willful damage.
