    Receipt of Service

    I received that MB Arbitration package via FED EX - and it states I have 30 days to respond from 'receipt of service'. The introduction letter is dated 3/13/08- yet I didn't sign for the package until 3/21/08. So do I have until Apr 12th to respond, or Apr 20th-since I didn't 'receive' the package until 3/21? The doortag was put on my door on 3/18- I legitmately could not get to the FEDX facility until the 21st.

    I believe it is from the time you signed for the documents when you picked them up. However I'm not 100% sure, you should ask a lawyer in your area
    May 31st, 2007: Petition Filed by my lawyer
    July 2nd, 2007: 341 Meeting Held
    September 4th, 2007: Discharged and Closed.

          No probably not- HHM- you're 'sticky' comment on "Creditors Lawsuit and Judgments" under the Collections Problems forum REALLY put me at EASE. Thanks for that- I really needed a general timeline on when MB will actually file a complaint, and when I should be served. Question: after the 30 day period expires after I sign the pkg for the arb papers- looks like I have until Apr 20th- how long does it usually take before MB will file a complaint? is it usually the next day- in my case the 21st? tks.

            Actually, when arbitration is involved, the time line can be a little shorter. What happens is, after the arbitration has occurred, all the creditor needs to do is apply for a judgment based on that arbitration award.

              i still have to be served though right? once i get that i will then file.
