    Should mortgage not reaffirmed be IIB?

    I have a question. We did not reaffirm either our first or second mortgage. In fact, we have decided now to let the house go. But GMAC/Ditech just reported us as late, at least with Experian. So I went online to dispute it. They were the only one who did not list it as IIB.

    However, Countrywide is not reporting as IIB on any of the three major CRAs. We will be missing our second payment in a couple days with them, although they have not reported us as late yet.

    I guess my question is to just double-check. Because we did not reaffirm, they should be listed as IIB on our credit reports, right? Furthermore, after the foreclosure, will it only show up in the public records portion of our reports? There should be no reported lates, I'm assuming.

    I'm no expert, but my understanding is if you are surrendering the property, then the mortgage company has to report IIB. It's possible that they can wait until your case is discharged to report that though - I don't know for sure, but that would be my guess. Most of my credit cards began reporting IIB once they were informed of the filing, but I assume it's legal for them to wait until the case is discharged before reporting that.

    I haven't seen my husband's report, so I am curious about this as well (he's the only one listed on the mortgage). I figured I could wait until discharge to start worrying about fixing any errors.
