I filed for BK September 2007 after divorce. Debt was discharged in January 2008. I turned in my federal and state tax information forms to the Chapter 7 trustee but have not heard back. I've left messages for the clerk and have yet to hear anything. My question is when is it safe to spend it? I got back $2,600 and I could really use it towards living expenses right now because I ended up losing my job last year. Is it normal for the chapter 7 trustee to take this long? I'm just afraid he might contact me at the end of the year wanting it back. Please advise.

Is you BK case still open. (note there is a difference between your case being discharged and closed).
If your case is "closed", then it is probably safe to spend the refund. If the case is still open, you will need to wait to hear from the trustee. -
i filed tax after case got closed. .....so im keeping refund.... now to think of it i wish banks never ever approved me from the beginning. again, my sister (realtor) did all the paperwork, which, later i found she falsified income and worked with this broker who were blinded with commission. i didnt know a thing and was stupid....
i let her do all, and just gave her my savings money... saw the house and was amused... thinking wow i can have a house too?
but yeah... big mistake
she falsified... how did i know? collection agent told me what my income was in an application.
