Ok I am now under Chapter 13 but I can't make my payments due to health problems. I have an attorney for my 13 case and his fee is paid under my 13 plan. I am going to convert to a chapter 7, can I file chapter 7 on the attorney that is representing me under 13? I have a prepaid legal service that will take care of the chapter 7 for me.

1. Why did you file chapter 13 in the first place.
2. Have you made any payments to your chapter 13. (any money already paid to your chapter 13 plan is gone, and since your attorney is the first to be paid, he will get something).
3. You will first need to do a substitution of attorney. -
We filed 13 before we knew about the medical problems and I checked my case online and my attorney has received nothing to date all payments went to other creditors. My prepaid legal service is suppost to get in touch with me sometime in the next day. I just want some insight into whether this can be done.Comment
