I plan on filing bankruptcy when i get my tax return back because I can not afford it right now. The other day I received a summons because Discover card is taking me to court. If I plan on filing bankrupcty, do I need to go to this? Also, if they do get a judgement against me what exactly does this mean? Can they take my tax return?

ty for your help

Hi! I just researched this myself today 1/14. If you check your states statutes, there is something called the list of Exemptions. This is a list of items: house, car, income, personal assets (jewelry, furniture), etc. Every state differs.

I did see a particular state where they may garnish your taxes and any income that you receive---they may take a % of the amount earned...or something like that. Check it out.

I will try to post a link to the site I visited which had a listing for all states. You can try searching "bankruptcy courts"...related links usually provided.
