    Converting from a 13 to a 7

    Hey folks,

I hope someone can answer this. The only thing holding us back from doing a chapter 7 is being behind on our mortgage payments. If we file a 13 now (we have a garnishment against us that I am trying to shake because it is getting a big chunk of my paycheck), would we be able to convert to a chapter seven in say...August or September? I will be receiving a large payout in the Fall from a stock plan. I could use it to catch the house up, etc. Could we start a Chapter 13 to solve our immediate problems, withdraw the filing in August and possibly refile after that under chapter 7? If so, how long would we have to wait so that the stock payout isn't an issue? I am not trying to do anything fraudulent so if that is how it looks, I won't do it. I won't be able to pay all medical bills and credit card bills with the stock payout so chapter seven will still be necessary...

    Thanks.
