With the new law coming this October, is it too late to file the petition?

Too Late To File

I've read that the deadline for filing under the current law is Monday, Oct. 17, 2005, and that certain stipulations have gone into effect since the law was signed in April. I am somewhat unclear about what those are, but believe some pertain to homesteads. There is quite a bit of information online if you don't have an attorney to ask at this point! Good Luck!

You have until 11:59pm on October 16, 2005 to file BK and have the existing law apply to you. After that, the new law takes effect.

Granted, there are some provisions of the NEW law that are already effective, but most of those are administrative provisions that don't effect debtors (but yes, the homestead cap of $125,000 in the new law applies now).
