    no return phone call from paralegal..ugh!

    Okay, my 341 has been set for 5/1/08. The day after we signed I found an error on my income, it is big enough that instead of only being $300 under the median income, we should be $2000 under. I also realized they never asked for a copy of our 2007 State tax return of $328, as I am sure this must be disclosed. I can't get a call back...I am supposed to go thru the paralegal for everything but I have been emailing and calling since 3/28 with no response. Can I just make these amendments be known at the 341? Or is it better to make sure the trustee has them ahead of time? I have been informed that my trustee is a stickler for perfection and I want to make sure she has good, accurate information...not a bunch of changes at the 341. Please, can anyone tell me what they would do in this situation?

    If your under, you are under, it really does not matter by how much. So, although it is mistake, it is a mistake without consequence.

    Also, your 341 is still weeks away, so there is time.

    But, if you really have been calling since 3/28, there is no excuse for not getting some type of response.

      Send a letter to your attorney return receipt requested. I bet you will get a response then. Most attorneys work better if they have something in writing - sad, but true.
      11/14/07 -filed C7 12/04/07 -case pulled for random audit.12/18/07 -341 held: Asset case due to engagement ring & tax return.02/19/08 - US trustee files motion to extend. 04/02/08- changed back to NO ASSET! I get my ring back and get to keep my tax return! :clapping: 04/28/08 -DISCHARGED!!! :yahoo::yahoo: 05/07/08 - CLOSED!!!

        Thanks for the replies, I wasn't sure if I was "splitting hairs" here or not. I am self-employed and have business expenses that come into play. My fear is that for some unknown reason the trustee tries to beat down my expenses on my p/l sheet, then I may be too close for comfort. The attorney said my P/L was fine and that nothing looked out of line...but you know how BK paranoia can take over.

          The mistake should be fixed, but at the same time, it is not a fatal problem.
