341 continuance

    341 continuance

    We had our 341 meeting on Tues, and it was continued, the trustee was requesting more paperwork. I asked the lawyer if this would delay our dates, he said no. (Does that seem right? Wouldn't our discharge be pushed further away because the 341 was not "closed"?) Also, has anyone ever had a continuance and had to appear in court on the date stated for the continuance? My lawyer said that we will not have to go, in his 20 years of practice only 1 person has had to go, and that was a fraud case.
    Any insight appreciated!

    the trustee has to file a motion to extend the actual deadlines or discharge they probably gave you a deadline to give them the info they wanted right? so that shouldnt affect the objection or discharge deadlines. what info did they want?

      We have to reappear because of documentation. The U.S. Trustee asked for additional paperwork from us and we didnt send them everything - because we didnt have it at the time. Anyway the trustee filed for the motion to extend time and it was granted by the judge...surprise, surprise. Anyway we received a letter from the trustee with a list of 21 different things they wanted copies of. At least 6 of them dont apply to us. It is a generic letter with our personal situation factored in. We have gathered all the paperwork (and it is a lot) and are meeting with our attorney on Thursday. The paperwork has to be in by July 29 and grab this...we have to meet with the U.S. Trustee August 3. Actually I am not afraid of meeting her face to face and in fact, I relish the thought. We have a very compelling situation and if we are turned down at least we will be able to have our day in court with her. She sent a really nice, almost apologetic letter to our lawyer about the situation. That remains to be seen whether they holds up come August 3. Word of advice...give them whatever they want so you dont end up where we are.

        Edwards2 - How close were you to a discharge when the US Trustee sent a letter for an extension? Our last day of objections was 7/12 and we still haven't heard anything.

        Can the US Trustee file for an extension/file a motion for a dismissal AFTER our last day of objections? Or, is there a chance that since the courts are so busy that there could have been objections/dismissal filed BY THE DEADLINE but they have not sent out the notices yet? Has anybody had this experience?
