My husband and I are finally deciding to divorce after his extra activities. I'm having a hard time deciding if I want to dismiss my chp 13 case altogether. If I dismiss, I can afford to pay all my credit debt, any that have read my post before what put me in the situation I'm in is 2 properties being surrendered. The foreclosures will go on as planned, but I'm scared of the deficency claim afterwards. I heard that most lenders do not come after you, but being that I had filed for bk and then have it dismissed they may feel differently about it. However, I can't imagine going the next year or more knowing that I have to get money from "him". We did plan to pay off early by taking money out of his 401K, but I can't do that until the property actually forecloses. No telling when that will happen. The average is 6 months in FL and 1 lender hasn't even started.
Does anyone know too when the deficency balance actually occurs...when the bank actually sales the property or when it is foreclosed?
