Selling house after discharge & proceeds

How long after the discharge do I need to wait to sell my house to be able to get the proceeds from the house sell?

I may need to sell the house. My 341 meeting was on April 29th. So, I est. discharge date June 29th. I would like to get the proceeds of the house, if I'm going to keep it afloat to sell it. Otherwise, I am thinking of not paying the mortgages any longer. Soon to be ex said he will not be paying the second mortgage and I can't do it... nor have motivation to beg/borrow it from a family member. However, MAYBE the proceeds of the sell could motivate me now, as he is unwilling to quick claim himself off the title (I tried asking tonight and he wouldn't do it. He'd rather the house go into the BK than quick claim himself off & me struggle with the payments - we have two kids, 5 & 8 & I wish I could keep the house for them...but I really just don't think I can)

If your ex cannot help pay and you already know that payments will be tough, I think you already answered your question. There are a lot of places to live and if you start now you will be fine, but, if you wait out the storm and try to sell it on your own I am afraid you might wish to have it listed inthe BK.

I only am saying that the market out there for homes sucks, so I would hate to see you being discharged and now stuck with a 1st & 2nd mortgage on you head. I believe if you could wipe those clean now, it will make things a lot easier for you. And it will get the elephant off your back - I know - I been there!!

Personally I'd probably amend your bk papers and let the house go in bk. I know its hard, but its probably the best choice. Look around and see if you can get a rental or other property to meet your needs.
