I drive a 15 yr old pickup truck with 200,000 miles on it, and I think it may be on its last legs. Things are breaking often, it blows smoke, vibrates real bad etc etc. I have been looking at a brand new Toyota Yaris that is under 15k and gets very good gas mileage and stuff. MY question is, I am going to be filing chapter 7 sometime in June, should I buy a car now and then re-affirm it in the bankruptcy process? Or is this not allowed? My schedule J shows me with disposable income of around $400. With a car payment of 300 and the increased insurance, my disposable income would be under $100. Does this look bad to the trustee? I dont want to commit any sort of fraud or be accused of that. It is not an extravagant vehicle, just a small compact economy car. I only drive 5500 miles a year, but it would be nice to have a new car with warranty so i dont have to worry so much. If anyone else has gone through this, let me know your thoughts. I have met for consultations with attorneys, but have not retained one as of yet.

I don't think it is a problem. Personally I would try to use up all that disposable income in purchasing a car or get really close. Yes, you can reaffirm the car in BK or you can just do a ride through and continue making the payments. If you are asked why you bought the car you have a good answer so I wouldn't worry about it. Many people go out and buy a car before BK.Filed!!04/23/2008[X] 341 5/27/2008[X]
