    trustee resigns from case?

    Hi all. Just wondering if this is anything to worry about. We just filed about a week and a half ago, and this weekend, received a letter saying we have been assigned a new trustee because the former one resigned from our case. We have not had the 341 yet. Is this something that I should be concerned about? Has this happened to anyone else?

    That's a new one. I wouldn't worry about it. The trustee may just be bogged down with the ever-increasing number of people in the same boat we're all in!

      Okay - just found out why after talking to my lawyer's secretary. Apparently, the original trustee had reported a conflict? The secretary mentioned that we might have spoken to him at some point. It just dawned on me that he was a bankruptcy attorney that we had consulted with prior to choosing our current attorney! lol. That's too bad, because he was a nice guy - was just too $$$ for us! he even charged a consultation fee to meet with him. I think he would've been a good trustee to have, though : ( , cause he was so nice. My lawyer had mentioned that the panel of trustees in our district are all pretty nice, except two, so I asked the secretary if he was one of the "meaner" ones. Her response was "he's a medium." oh well, at least she didn't say he was difficult. ugh. too bad she didn't say he's one of the nicer trustees.

        Our trustee was very nice at our 341 hearing, even had a sense of humor. It put us at ease. "Medium" wouldn't be bad, either, as long as they are fair. Good luck!
