    3 questions
    1) If you want to keep your home, do most mortgages require a reaffirmation?
    2) If you don't reaffirm and keep making payments, can you walk away at a later date?

    This one for a friend
    3) If in your paper work you indicated that you wanted to keep your home, can you change your mind before your hearing and/or discharge? Can you let them know at your 341, or do you have to file some additional paper work? This person had a local bankruptcy firm (not lawyers, just people who fill out the forms for you like the on-line ones do....but for $350), and they told her that they would have to have her retrieve the papers she already filed with the court, fill out new papers and then she would have to pay both fees over again (the $350 to them and $209 to the court). Sounds pretty strange to me.

    hi teri, i am currently filing ch.7 myself, my 341 meeting is aug.23rd. i am planning on keeping my home as well, as far as i know (and was told by my attorney) that as long as you are current on your payments and keep making those payments you don`t have to reaffirm. but this may be different in your state. what state are you filing in? i am in s.c.
