    Prior to 341 meeitng

    I just got a packet from the trustees office and it had a list of all the information I had to provide 7 days prior to my 341. It stated the last 4 wage statements. Does that mean the last four before the 341 or before I filed?

    I hope it's before I filed. My attorney told me it would be.

      Chloe, I don't remember any packet we got. Only advice to have our SS card, ID, and in our case a marraige license since my wife and I use different last names. 'Hub

        my best guess would mean the most recent as in the ones just before the 341because a whole month can pass from the time of filing. sometimes they request the paystubs or additional figures for a month after the 341 as well.

        It stated the last 4 wage statements.
        There is no absolute on what & when they can request additional paystubs & things like that, only basic guidlines.
        OTH, some people would not have 4 more wage statements from filing to the 341, they may only have one or two, so you would end up including some that you already showed to the attorney if they really mean four as in from the time of the filing.

        Didn't your attorney already ask for about 6 months wages to the the date of filing?
        I would not worry too much about that part of this process.

          He did ask for 6 months, but said that the trustee in my district only looks at the last 2 months for a 13. I hope that it's the ones prior to filing because I got a bonus since I filed. I used it to make much needed repairs to the car and house.

            Chloe, the packet I received from my trustee said that I had to provide pay stubs 'within 60 days of filing'. So even though I'm bringing every pay stub since then to my 341, I only mailed out the ones previous to filing.
            May 2008: Filed Chapter 13
            Jan 2010: Plan Amended and Confirmed! finally plan funds = total funds due!
            Jul 2013: 5 years done! Trustee set to discharge! Woo hoooo!

                I asked my attorney about the 6 months of pay advice prior to the 341, and he assured me that it was the six months prior to the BK filing date. I received a notice from the trustee a week before my 341 meeting outlining the documentation that would be necessary, and I just allowed my attorney to "do his thing", so to speak.

                Since all of the number-crunching is completed even before filing, I don't see where it is of any benefit to the trustee to examine your earnings between the filing and the 341 meeting.

                  well, since you will be in a 13 & if the bonus is just a one time thing that showed up as income, and if your main concern is how you can keep the bonus in case they ask (?) then maybe consider spending the bonus if you have to. by that I mean something that you really needed like food for the pantry or an auto repair, school clothes, & keep the receipts, not just blow the bonus on any old thing. Or be prepared to explain the bonus & what you did with it, if it is more than $1000.00. If you think you will be asked because he wants to see more recent, & catches the bonus. It sounds like you already gave him what he asked for before you got the packet.

                  The above is NOT advice, but only the terms thAT I would be considering due to the nature of the question & timing of things.


                  BUT! you dont really need to do anything at this point & only will need to be concerned if he gets the stub with the bonus. so you can stop the worry by being prepared for all possible outcomes, chloe

                  I am sure they may ask you for current income along the way or you may be expected to reveal a raise or decrease for your income and payment plan, but maybe not so much a one time bonus.
                  Q)Would all your checkstubs following the bonus be the same as when you filed & both prior & after the 341?

                  Keeping my fingers crossed because not all of these attorneys & trustees are that rigid about everything. They are more or less looking for thousands.

                  Expect the best but be prepared for all possibilites. Wait to hear back from your attorney as well. If you can flag the attention of lrpn, they will have a better insight on possibilities.

                    Thanks Bandit. Yes, it is a one time deal. I have spent most of it, mostly for repairs to my car, which is almost at 80k miles. Every other check looks like it did when I filed.

                    I still haven;t heard back from my attorney, but I think that I may be worrying for nothing.
