    Above median Ch. 7 success stories?

    Our second 341 hearing is coming in a few days and I'm feeling really pessimistic. We've done all we can and it's up to the local and US trustee to decide whether our expenses are "reasonable and necessary". Any inspiring above-median income success stories out there? How far above median and was there a statement of presumed abuse filed?

    Hang in there Mine wasn't such a case but I've seen a couple go through, sometimes they take a bit longer. Just don't give up
    May 31st, 2007: Petition Filed by my lawyer
    July 2nd, 2007: 341 Meeting Held
    September 4th, 2007: Discharged and Closed.

      I think if you search around on these boards you'll find plenty of above-median debtors who had a successful discharge. Just requires a few more hoops sometimes to jump through.

        My "hoop" is now 120 days after my 341. I have to pay $450 over payment to buy my own stuff back, for one year. My adversary is coping a AP on a lawsuit so he can pat by grave with the last shovel of dirt while he burries me. He being a contributor to my demise. BUT I hang in there and help others since there is always someone worse off. Here I am.....lol.... Even if dismissed, I shall go for it again, many of my creditors have already wrote us off.

          My income was twice the mean income threshold
          in California.

          I could prove my expenses were higher than monthly
          take home income.

          Trustee only requested a copy of payments to child care
          provider. I showed $1100 a month. Faxed over the bank
          transaction records and he was satisfied.

          Judge reviewed my tax returns and found no objections.

            To Help:
            Did you go into your 341 knowing you had presumed abuse?
            We are in Cali also and we're about $45,000 over median but did not have presumed abuse due to priority child support owed.We had our 341 this week and we are keeping our fingers crossed! Still nothing on pacer about the 341 I think I read the trustee has 10 days to report the 341??? Living in Cali we have a huge mortgage and with the drop in home values we are hoping everything goes through smoothly but I guess anything can happen still in the next 60 days.

              Thanks all. vleisme, we were completely clueless at our first 341 and had no idea that our BK would be anything but smooth sailing. We were told by our attorney that we met the means test and a lack of disposable income qualified us for Ch. 7. We were stunned by the presumed abuse statement filed exactly 10 days after our first 341 hearing and at the volume of documentation requested by the UST. I will keep my fingers crossed for you that nothing shows up on PACER, but you're right... it isn't over 'til it's over.

              'Hub, hang in there also. Still following your story and hoping for the best for you and ACat. If you can manage to laugh at the incompetence of your attorney, you're in good shape. I'm not quite in that place of healing yet.

                Same as Still_Standing..
                My income was almost 3x the median and I still pushed through a CH7. My debt was over $600K with the rental property.
