Just 5 days after "Presumed Abuse" its amended to "No Presumbed Abuse". Is he done??

I swear they are just messing with me. We didn't even do anything. I didn't send in the "more information" because no-one told me or my lawyer what "more information" they wanted. Now just 5 days after the presumed abuse its amended to "no presumbed abuse". Im so not complaining here but do they have to stress me out this much. What does this mean now??? Is the US Trustee done with me?? Someone please let me know.

I think that means the UST has reviewed the docs you sent and has decided to withdraw his presumed abuse statement...it's a good sign I believe

Not so fast! Do you have non-consumer debt involved in your bankrupty, i.e., business debt. The UST may be just saying that he/she is giving away the "abuse" section of the Code, but is looking to have the bankruptcy dismissed under another section. Search for the threads that I started (rfassett) and you will see why you should not jump to conclusions. I do hope your road is less bumpy than mine was.

Nope no non-consumer debt involved. I have a continued 341 scheduled on the 30th, Im hoping that gets cancelled now. There was something he was looking at there or he wouldn't have gave me the "presumed abuse" to begin with. I know your right that there may be more hes going to throw at me, but Im over one bump. I hope.

Dragonfly, this is good, very good. The UST is declining to file a motion to dismiss.
Good for you!!! Don't celebrate yet, but I would take this as a really good sign...

My lawyers paralegal called today and the US trustee had asked for the tax returns yesterday AM. They faxed them to him, and with in a hour or so called back and said he was "backing off" Im glad the lawyer had the tax returns already or there may have been a few more days involved. They said all I have to do now is wait for discharge!!!! Trust me Im not getting overly excited that we might be in the clear. But Im definitly happy. It does still say the meanyes and 707 whatever in my flags. But she said it will take a few days for the locals to get that removed. I would just like to be the over the median that goes through in the typical 4 months. That would be nice. We have no assets to distribute. They never mentioned the stimulus check. Hopefully my next post will be DISCHARGED....
